The case was a white-collar crime and was investigated by the El Paso County Sheriff's Office and the Department of Homeland Security and prosecuted by the District Attorney's Economic Crime Division. The district attorney insisted that the client plead guilty and the case proceeded to litigation. The Bussey Law Firm, P.C., filed a Motion to Suppress evidence based upon an illegal search. The court found that the search was illegal and suppressed the majority of the prosecution's case. The case was subsequently dismissed by the District Attorney's Office.
